  1. PRE-RELEASE SOFTWARE CONFIDENTIALITY AGREEMENT

  3. YOU HAVE ASKED TO PARTICIPATE IN A CLOSED BETA-TESTING PROGRAM FOR A
  4. PRE-RELEASE PRODUCT BEING DEVELOPED BY EA.COM INC. ("EA.com")
  5. CALLED "EARTH & BEYOND" (THE "PRODUCT").  IN ORDER TO
  6. PARTICIPATE IN THIS PROGRAM, YOU MUST AGREE TO THE FOLLOWING
  7. PROVISIONS.  BY CLICKING THE BUTTON LABELED "I AGREE", YOU INDICATE
  8. THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THE FOLLOWING:

  10. 1. Your participation as a volunteer tester of the Product is purely voluntary.  You will not
  11. receive any compensation of any kind as a result of your participation as a volunteer tester.
  12. You may stop being a volunteer tester of the Product at any time that you wish.
  13.  
  14. 2. You acknowledge that the version of the Product that you are testing is beta-version
  15. software that is not complete, has not been fully-tested by EA.com, and is not ready for sale
  16. to the general public.  The Product may have bugs and other problems that make it unplayable,
  17. and that could potentially cause damage to your computer equipment. You agree that EA.com will
  18. have no liability to you for any problems you have regarding the Product, or for any damage
  19. that the Product may cause.

  21. 3. You acknowledge that all materials furnished to you by EA.com as part of the beta testing
  22. program, whether by disc, document, download or any other means (collectively, the "Beta-Test
  23. Materials") are being shared with you for a limited period of time.  EA.com may discontinue the
  24. Product beta testing program at any time, for any reason, without notice.  EA.com may modify or
  25. delete Beta player characters at any time, for any reason, without notice.  All rights, title
  26. and interests in and to the Beta-Test Materials shall, as between EA.com and you, be and remain
  27. the sole property of EA.com.  Nothing in this Agreement shall be construed as granting you any
  28. rights of any kind with respect to the Beta-Test Materials, other than the privilege to review
  29. the Beta-Test Materials during the period specified by EA.com, solely for the purpose of
  30. evaluating the Product (an "Evaluation").  EA.com may request that you return any Beta-Test
  31. Materials at any time for any reason, and you agree to immediately comply with any such
  32. request.

  34. 4. You agree that: (i) you will not copy or reproduce the Beta-Test Materials; (ii) you will
  35. not use the Beta-Test Materials for any purpose other than for Evaluation; (iii) you will use
  36. the Beta-Test Materials in strict compliance with the provisions of this Agreement; and (iv)
  37. you will carry out the Evaluation personally and will not provide access to the Beta-Test
  38. Materials to any other person.

  40. 5. You agree that you will not alter the Beta-Test Materials in any manner, nor remove any
  41. copyright notice, trademark notice, and/or other proprietary legend or label set forth on or
  42. contained within the Beta-Test Materials.

  44. 6. You agree that you will not disassemble, decompile or reverse engineer the Beta-Test
  45. Materials, or any part thereof.

  47. 7. This agreement is personal to you, and you may not assign this Agreement, nor any of your
  48. rights hereunder.

  50. 8. This Agreement constitutes the entire agreement and understanding between the parties with
  51. respect to the subject matter hereof, and supersedes all prior and contemporaneous
  52. negotiations, discussions and understandings of the parties, whether written or oral.  Should
  53. any provision of this Agreement be determined to be void, invalid or otherwise unenforceable by
  54. any court or tribunal of competent jurisdiction, such determination shall not affect the
  55. remaining provisions hereof which shall remain in full force and effect.  No waiver or
  56. modification of any of the provisions of this Agreement shall be valid unless in writing and
  57. signed by both of the parties.
